How do I know if my vehicle is a lemon?
There are two components to knowing whether you can go for a lemon law claim: 1) if your vehicle qualifies for lemon law protection and 2) if the lemon law considers your vehicle to be defective.
Defective Vehicle Criteria
Under the California Lemon Law, a vehicle is considered a lemon if it has a defect that affects its use, safety or value, and an authorized dealership or repair shop couldn’t fix the defect within a “reasonable” number of attempts within the warranty period.
The number of attempts considered “reasonable” will vary case by case. However, at least one of those attempts has to happen before the warranty expires.
Vehicles Covered by Lemon Law
The California Lemon Law protects new or used motor vehicles if they were bought or leased from a dealership in California, if that vehicle has a warranty issued by the auto manufacturer. The vehicle has to be owned or leased by a California resident and set aside for personal, family or household use.
However, there are exceptions for owners of small businesses and members of the Armed Forces. A vehicle can be set aside for business use if the business has no more than five vehicles, each one under 10,000 pounds. Members of the Armed Forces can pursue California lemon law claims if they purchased vehicles in California before serving elsewhere in the country, or if they purchased vehicles elsewhere in the U.S. before being stationed in California.
The Lemon Law Process
The first step to any lemon law claim is to get a legal consultation on your potential case.
Our initial consultations are completely free. The consultation can take as little as five minutes, depending on how many questions we ask, and how much you share during the consultation. We typically ask you about your vehicle model, the problems you’ve been experiencing and the repairs you’ve had on your vehicle so far.
At the end of that consultation, we’ll request certain documents for another layer of review. This typically includes repair orders and warranty information. These documents will be used to determine the viability of your lemon law claim.
How much do lemon law services cost?
You will not pay any costs out of pocket for our lemon law services. That’s due to a particular rule in the California Lemon Law. If you win your lemon law claim, the auto manufacturer has to pay for your attorney’s fees and costs. If you lose against the auto manufacturer, we don’t get paid. Either way, this clause exists to even the playing field between consumers and auto manufacturers.
Your financial situation will not determine whether our lemon law attorneys help you. If you have a car, truck or other vehicle with problems that won’t go away, we can begin the lemon law process by offering you a free consultation at our 24/7 number: 877-222-2222.
